Gun collection seized, man faces charges

Superior Court Judge Duane Martin ruled Monday afternoon that Rail Road Flat resident Dale Albert Buller, 79, must appear at 9 a.m. May 19 to plea to nine criminal charges brought against him by the Calaveras County District Attorney’s Office.

“For purposes of the preliminary hearing, I think there is probable cause that the charges were committed,” said Martin over his attorney’s objections. “The court is going to hold Mr. Buller to answer for the charges.”

Buller was arrested last month for a traffic violation, but it was soon discovered that he had a warrant out for his arrest for felony firearms violations of his probation dating back to October 2007.
Buller was released on his own recognizance without posting the $1.4 million bail earlier set by the judge. The decision to let him go was medically related, said Lt. Dennis Huberty, who is in charge of the jail. “You don’t keep somebody in jail that needs medical attention,” he said.

Huberty would say little more, in order to protect Buller’s medical privacy, and other officials and attorneys involved in the case were equally mum.

" Its about time that Dale Buller be brought forth to face the music for some of his crimes!!! And what about posting some of the money for his bail? Or paying back the county for money they already have spent on him? "
