5. Public Hearing:

A. 2003-45 TENTATIVE PARCEL MAP for DON FABBRO and GAYLA WILSON The applicants are requesting approval to divide 24.2 ± acres, into four (4) parcels of 5.0, 5.0, 5.85 ± and 8.31 ± acres respectively. The property is located on the north side of Cottontail Lane off Messing Road approximately 1¼ mile west of Burson. (APN 48-025-198 is located in the Northwest ¼ of Section 29, T4N, R10E, MDM).

B. 2003-141 CONDITIONAL USE PERMIT for MARCELL ENGSTROM. The applicant is requesting approval of a Conditional Use Permit to add an addition to an existing residence and a new metal shop/storage building. The parcel is currently zoned C1 (Local Commercial) with a land use designation of Neighborhood Commercial in the San Andreas Community Plan. The property is located at 262 High School St., northerly of State Highway 49 (St. Charles St), in San Andreas. (APN 42-010-04 is a portion of the Southwest ¼ of Section 17, T4N, R12E, MDM).

C. 2003-158 CONDITIONAL USE PERMIT and VARIANCE for CASTLE & COOKE SADDLE CREEK, INC. The applicant is requesting a Conditional Use Permit and a Variance to place a Billboard sign for Saddle Creek Golf Community. The current zoning is C2 (General Commercial) . The proposed sign is located 500′ feet west of the Reeds Turnpike Road intersection with Little John Road, on the south side of Little John Road.. (APN 54-006-27 is a portion of the Northeast ¼ of Section 4, T1N, R12E, MDM).

D. 2003-74 TENTATIVE SUBDIVISION TRACT MAP for JERRY W. and JULIANN HOLLANDER. The applicants are requesting approval to subdivide 83.27 ± acres, into 13 parcels of 5 acres and 2 parcel of 6 ± acres. The property is located on the south of Southworth Road and west of Evergreen Road in the Burson area. (APN 50-050-018 is a portion of the North ½ of Section 6, T3N, R10E, MDM).

E. 2003-90 TENTATIVE SUBDIVISION TRACT MAP for JOHNNY Q. HAYES The applicant is requesting approval to subdivide 80.16 ± acres, into 16 parcels of 5 acres. The property is located on the south side of Southworth Road and west of Evergreen Road in the Burson area. (APN 50-050-17, is a portion of the North ½ of Section 6, T3N, R10E, MDM).

F. 2003-108 GENERAL PLAN AMENDMENT & ZONING AMENDMENT for ADOLFO GOMEZ. The applicant is requesting a General Plan Amendment to change the land use designation for three (3) parcels of land and all that portion of APN 48-011-021 within the Northeast ¼ of the Southwest ¼ of Section 21, T4N, R10E, from Residential Centers to Community Centers. Concurrently requested is a Zoning Amendment on APN 48-012-002 from A1 (General Agriculture) to C2 (General Commercial) for 2.74 acres in order to permit a beverage storage and distribution facility. The properties are located on the south side of State Highway 12 just east of Burson Road in Burson. APN 48-012-002 is the site of the El Torero Restaurant. (APN’s 40-011-021, 48-012-001, 48-012-002, and 48-012-007 are a portions of the South ½ of Section 21, T4N, R10E, MDM).

9. PUBLIC HEARING and possible Board action re: the following: Planning

a) 2003-91 ZONING AMENDMENT and CONDITIONAL USE PERMIT for CINGULAR WIRELESS. The applicant is requesting approval of a Zoning Amendment from U (Unclassified) to RA (Residential Agriculture) for 9.9 ± acres.

Concurrently requested is approval of a Condition Use Permit to construct a wireless telecommunications facility consisting of a 80-foot monopole with 12 antenna panels, two (2) microwave dishes, and ground mounted equipment cabinets at the base of the pole. The property is located at 2462 Highway 49 on the west side of the highway across from Gun Club Road south of Angels Camp. (APN 64-005-038 is a portion of the Southeast ¼ of Section 3, T2N, R13E, MDM). – Board action:

b) 2003-98 ZONING AMENDMENT and TENTATIVE PARCEL MAP for MICHAEL CARROLL. The applicants are requesting a Zoning Amendment from RR-10-MH, (Rural

Residential – 10 acre density – Mobile Home) to RR-5 (Rural Residential -5 acre density) for 10 ± acres. Concurrently requested is approval to divide their property into 2 parcels. The property is located at 8890 Live Oak Lane, off Ospital Road approximately 3 miles northerly of State Highway 26 in the Jenny Lind area. c) 2003-103 ZONING AMENDMENT and TENTATIVE PARCEL MAP for STANLEY and FAY FORD. The applicants are requesting a Zoning Amendment from U (Unclassified) to RA (Residential Agriculture) for 12 ± acres. Concurrently requested is approval to divide the property into 2 parcels, one at 5.5 ± acres and one at 6.5 ± acres. The property is located at 4238 N. Railroad Flat Road approximately ½ mile northeasterly of the Townsite of Wilseyville. (APN 10-019-24, is located in the Northwest ¼ of Section 14, T6N, R13E, MDM). – Board action:

d) 2001-134 COUNTY INITIATED ZONING CODE (TITLE 17) TEXT AMENDMENTS Based on the County’s need for immediate amendments to the existing Zoning Code, on January 28, 2002, the Board of Supervisors adopted Minute Order initiating an amendment to the zoning code. County staff identified Zoning Code amendments as being critical to complete in the short term. The amendments cover the following issues:

1. Revising the current provision in most of the zoning districts that allows single-family dwellings on each parcel at a ratio of one dwelling per General Plan density requirement to one primary dwelling per existing parcel. (Substantive change);

2. Distinguishing between fishing clubs and hunting clubs, provide additional regulations for hunting clubs, and add fishing and hunting clubs as a permitted use in the AP zone (Corrective Amendment)

3. Providing setback requirements for dwellings when allowed in commercial zones (Codification of established County policy);

4. Include language to document current variance procedures relative to occasions when a variance will be heard by the Planning Commission (Codification of established County policy);

5. Clarify current regulations for camping on private property (Clarifying change);

6. Clarifying the requirements of the EP zoning district regarding allowable structures and their location (i.e. single-family dwellings) (Clarifying change); and

7. Clarifying the requirements of the PX overlay zone in terms of whether the sending or receiving parcel must have the overlay designation (Clarifying change).

The zoning code text amendments would apply Countywide. – Board action:

e) APPEAL by MIKE STROBEL of the PLANNING COMMISSION’S approval of 2003-101 CONDITIONAL USE PERMIT for CINGULAR WIRELESS. The appellant seeks to over turn the Planning Commission approval of the project. The applicant is requesting approval of a Condition Use Permit to construct a wireless telecommunications facility consisting of a 67 foot monopole with 12 antenna panels at a center height of 64 feet above ground level, two (2) 4 foot diameter microwave dishes at a center height of 57 feet above ground level, and up to three (3) ground mounted equipment cabinets at the base of the pole enclosed by a 6′ chain link fence. The property is located at 8812 Miwok Trail on the north side of Mokelumne Hill. (APN 16-017-028 is a portion of the Northeast ¼ of Section 12, T5N, R11E,
